אישה שדקרה את בעלה אחרי שנים של התעללות מצידו לא תשב בכלא על מעשיה.

ג'ודי אוון דקרה את בעלה בסוף השנה שעברה והשאירה אותו מחוסר הכרה ועם דימום כבד מאוד.

הבעל הכה אותה בעבר ובאחד המקרים העיף לה שייניים מהפה, בנוסף הוא גם תקף אותה במהלך טיול שלהם בספרד.

ההגנה של ג'ודי הוסיפו שהיא סבלה מפוסט טראומה כתוצאה ממות בנה וההתעללות שהיא ספגה מבעלה ומבן הזוג הקודם שלה.

שופט בבית המשפט בטיסייד החליט נגד הנכסתה למאסר לאחר ששמע את סיפורה העצוב.

ערוץ הדין של ג'ודי, ריצ'ארד בנט, אמר שהיא פשוט 'איבדה את העשתונות' אחרי שספגה תגובות והערות פוגניות מבעלה, מה שהוביל למקרה המדובר.

ריצ'ארד בנט הוסיף ואמר: " המתלוננת ואני מהססים בשימוש במילה 'קורבן' היות והיא הייתה נתונה לחמש שנים של אלימות משפחתית. היא הגיעה ממערכת יחסים קודמת של תשע שנים שהייתה גם כן מאוד אלימה."

הוא הוסיף: " הטרגדיה של המקרה הזה מתבטאת בעובדה שהאישה הזו היא הקורבן. ההתנהגות הקשה האמיתית במקרה הזה הייתה בידיו של בעלה."

השופט אמר שהמקרה הזה יוצא דופן ונתן עונש של 10 חודשי מאסר אבל שיהיו בהשהייה לשנתיים הקרובות, וגם 30 יום של שיקום.

המשטרה נקראה במהלך החגים בסוף שנה שעברה לביתם של הזוג במידלסברו אחרי שקיבלו דיווח על דקירות.

היו לו שישה פצעים ביד מהתקיפה והוא היה מחוסר הכרה כשהמשטרה הגיעה למקום.

בעלה לא מסר הצהרה רשמית או תלומה והוא לא אפשר לרישומים הרפואיים שלו להיות בשימוש במהלך המשפט או אפילו צילומים של פצעיו.

אוון אמרה לבית המשפט שהיא פחדה מאוד שהוא עומד לתקוף אותה ולכן דקרה אותו.

השופט סיימון בורן-ארטון אמר: " זה מקרה מאוד יוצא דופן. הייתה הרבה מאוד עצבות בחיים שלך, כששום דבר מזה היה באשמתך, על פי שיקול הדעת שלי, זה מאוד לא ישרת את החברה שאנחנו חיים בה אם את תיכנסי לכלא."

הוא הסכים שההיסטוריית ההתעללות הייתה אמיתית ואמר שהיו ראיות ברורות מאוד המעידות על כך וגם כן ההרשעה הקודמת של בעלה כשהוא העיף לה את השיניים מהפה.

בעלה אמר שהוא רוצה להוציא לה צו הרחקה ממנו כדי שהיא "לא תנסה לתקוף אותו או להפיץ שקרים עליו בפומבי."
